Join Adv Ngalwana SC in this first of four segments in a frank interview with the Chief Justice of the Republic of South Africa, Justice Mogoeng Mogoeng.
In this first segment, the Chief Justice shares his insights on the following issues:
- The state of the Judiciary and its challenges
- Access to Justice
- Technology and Effectiveness of the Courts
- Whether an equally split-bench at the highest court is a failure of justice.
Waw thank you Ngwalana SC. This was thoughtful and rich interview. I can’t wait for the second segment.
I wish you can also deal more on access to justice. Courts can’t wait for the Legal Practice Act to full make sure that access to justice is achieved. That process by the Executive is long.
I agree. Some of the heads of courts are, as I understand it, working on some solutions
It has been my opion that the constitutional court worked as the legal aid boerd or law clinics. Poor comminities have genuin and ineresting case that requires speed answers. Going through the courts communities are sand bagged by rich institutions or persons. It takes about 10 yrs or so to reach the constitutional court even more. The judge did not offer what needed to done and how his concerns regarding access could be made better. The delay in judgement is also a worrying issue. I would like to ask one question, why a constitutional court would give a person a date in an urgent application just to tell tge person that the matter was never urgent. Why waist time and raise emotion. The person a court n date were assigned why dont just go ahead answer the question. Thank you
Thank you so much for this. Very informative interview
